These Terms govern your use of Outcomark. When you create an account, you must expressly agree to them using the registration form. We record the accepted version and acceptance time. Reading a footer link alone does not record your agreement. If you do not agree, do not create an account.
Outcomark operates an accountability and outcome-record service for organisations running structured programmes. Contact us at hello@outcomark.com.
An organisation creates cohorts and sends role-specific invitations. Organisers may assign measurable tasks to participants and, where enabled, participants may create their own. Each task records its target, deadline, evidence requirement, audience, reviewer requirement and optional assessment terms. Participants may save evidence drafts, attach multiple supported items, and submit a version for review before the deadline. Organisers may review any submitted version in a cohort they manage; assigned verifiers may review only their assigned submissions. They may provide feedback and use optional programme grading. The Service does not provide advice or coaching, rank participants, use AI to judge outcomes, or guarantee a result.
You must be at least 18, provide accurate information, protect your account, and promptly report unauthorised use. Organisation administrators must invite authorised people, assign roles correctly, choose lawful evidence and assessment requirements, review submissions fairly, and provide any notices or permissions their programme requires. Each email invitation is personal to its named recipient, is bound to that address, may be used once, and may be revoked, replaced or allowed to expire. It can be accepted only while enrolment is open and participant places remain subject to cohort capacity.
Each commitment is shown to the audience agreed when it locks. Evidence files, reviewer feedback and grades remain private to the participant and authorised reviewers and are excluded from programme summary exports. A summary export identifies participants by email address alongside their commitment and recorded outcome, and organisation administrators are responsible for how a downloaded export is stored and shared. An organiser may issue a checkable copy of a cohort’s programme record: it holds cohort counts and terms only, cannot be edited once issued, and can be viewed by anyone given its check link. A workspace owner may connect a Slack or Microsoft Teams channel, which then receives daily per-cohort counts and cohort names. A participant’s personal data download may include their own evidence and published reviews. Choose content appropriate for authorised reviewers and do not upload unlawful, confidential, misleading, malicious, or infringing material. You keep ownership of your content and grant Outcomark a limited licence to store, validate, process and display it only to provide and secure the Service.
Once accepted, a task’s audience, evidence requirement, reviewer and assessment terms cannot change. Before its deadline, an organiser may extend the deadline, and may change the task wording or target until evidence has been submitted. Every such change requires a written reason, is recorded permanently with who made it and when, is shown to the participant and is counted in programme records. A deadline cannot be brought forward, and nothing about a task can change after its deadline has passed. Before the deadline, a participant may withdraw a submitted version and create a new numbered draft. Withdrawal supersedes the prior version and any review or grade, removes its evidence items, and queues stored files for deletion; replacement evidence must be added and submitted again. The participant deadline closes participant edits, but an authorised reviewer may complete a required review afterwards while the task remains unresolved. At or after the cutoff, a task is recorded as delivered only when the submitted number meets its target and any required review is approved; otherwise it is recorded as not delivered. A grade does not determine that numeric outcome.
Do not use the Service for unlawful content, harassment, spam, impersonation, unauthorised access, malware, scraping, interference, or misuse of invitations, evidence, verifier, witness, or export features. Do not evade role, capacity, rate, upload or export limits, or submit another person’s confidential or personal information without lawful authority and any required permission. We may remove content or suspend access where reasonably necessary to enforce these Terms, protect people or systems, or comply with law.
To report content you believe infringes copyright, email hello@outcomark.com with the affected content or record, the work concerned and your contact details. Do not include other people’s private evidence. We review reports and may restrict content or suspend accounts for serious or repeated infringement, while preserving required record and legal facts. This contact is not a claim of registration as a US DMCA designated agent or of safe-harbour eligibility.
The Service depends on providers of hosting, authentication, communications, payment and security. Card payments for cohorts are processed by Stripe; we do not receive or store your card details. Existing historical subscriptions may continue under their original billing terms and can be cancelled through Account Settings where available. Separate third-party terms apply where you interact directly with a third party.
A cohort is charged once, when you activate it. Activation closes enrolment and fixes the roster. There is no subscription, no recurring charge, no renewal and nothing to cancel.
The price is set by the number of participants enrolled at the moment you activate, not by the capacity you set. The published bands are shown at Pricing. The first cohort of an organisation is free where it has ten or fewer participants, once per organisation. Prices are in US dollars and are exclusive of any value added tax, sales tax or other tax that applies, which is payable in addition where due.
Bands up to 120 participants are paid by card before activation. The band above that is invoiced rather than charged to a card; ask through Contact and we raise the invoice. Payment is required before a cohort activates.
A cohort is refundable in full at any time before it is activated. It is not refundable after activation, because activating closes enrolment and delivers the run. If enrolment grows into a higher band between payment and activation, activation stops and states the difference; refund the first payment and buy the correct band.
Any cohort activated before charging begins runs to its end at no charge. We may change prices; a change applies only to cohorts activated after we give notice of it, and never re-prices a cohort that is already running.
We will provide the Service with reasonable care and skill. We do not promise uninterrupted or error-free availability, or that scheduled processing will always occur at an exact time. Outcome records depend on information supplied by programme users. Nothing in the Service is financial, legal, medical, or other professional advice.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. We are not responsible for losses that were not reasonably foreseeable when you agreed to these Terms, or for business losses suffered by a consumer. If you use Outcomark for business purposes, our total liability relating to the Service is limited to the fees you paid for the Service in the twelve months before the event giving rise to the claim, to the extent the law permits.
You may stop using the Service at any time. Self-service account closure is unavailable while you have an open commitment, or while you are the only owner of a workspace other people use. Where resolved cohort records must be preserved for the programme, closure removes your personal details and keeps those records. Ending an open or active cohort is a one-way action: it stops new invitations and tasks, closes every open task without an outcome, rather than as delivered or not delivered, and preserves submitted evidence, reviews and completed outcomes. A completed cohort may later be archived. We may suspend or close an account for a serious or repeated breach, security risk, legal requirement, or discontinuation of the Service. Where practicable, we will explain the reason and give reasonable notice.
Cohort capacity, bulk invitation, task, evidence, upload and export limits shown in the Service apply. A cohort holds at most 500 participants, which is both the capacity limit and the top of the published price bands; a larger programme runs as several cohorts. We may change prospective limits where reasonably needed for security, reliability or product operation and will give notice where a change materially affects use. Accepted task terms change only through recorded amendments.
We may update these Terms for changes to the Service, law, or security. We will give reasonable advance notice of material changes. If you do not agree, you may stop using the Service before they take effect.
Applicable law and the courts with jurisdiction govern these Terms and any dispute. If you are a consumer, nothing here removes mandatory rights or prevents you from using a court or dispute process available under those rights. Please contact us first so we can try to resolve the issue.
